Military/Veterans Educational
Foundation (MilVets) wishes to establish an educational scholarship
program for the surviving loved ones of military service men or women
who have lost their lives while serving in Afghanistan or Iraq. The
intent and award guidelines for this educational scholarship program are
outlined below:
INTENT:
The intent of the educational scholarship is to honor the memory of US
service men or women who have given up their lives in military service
to this country. The deceased service man or woman is being honored by
granting to designated loved ones a 529 College Savings Plan or other
grant structure, as determined by MilVets, to be used by that loved ones
for post-secondary education.
 | The funds granted shall be used
for post-secondary educational expenses only. The funds may be used
for any purposes in the pursuit of a post-secondary education. These
expenditures may include (but not be limited to) tuition, fees, books,
room and board, and educational materials. |
 | Post-secondary education shall
include associates, bachelor, or graduate degrees; technical or
vocational training; apprenticeship programs; and other types of
training, including work-study programs. |
 | The amount and terms of the
scholarship grant will be established totally at the discretion of
MilVets or any representative to whom MilVets may delegate the
administration of the program. All decisions made by MilVets or its
designated representative shall be final and made with whatever
criteria it deems appropriate regardless of what actions or decisions
may have been take in the past or are taken in the future. All
decisions by MilVets or its designated representative shall be final. |
 | The existence or lack of
existence of such a contemplated educational scholarship at any time
past, present, or future shall not give any party any right or
entitlement to such a scholarship unless explicitly granted to that
party by MilVets or its designated representative. |
AWARD
GUIDELINES:
The criteria used by MilVets or its designated representative may be
changed at any time without prior notice or announcement. MilVets shall
not be obligated at any time to publish or otherwise make known the
criteria or guidelines used to award such educational scholarships. It
may at its own discretion, however, publish its then current guidelines
in any form, media, or venue it so chooses. The Trustees of MilVets
shall review the program at least annually to determine whether to
continue the program, the size of any educational scholarships to be
awarded, and the guidelines to be used in determining eligibility for
such scholarship. Past decisions by the Trustees of MilVets shall have
no binding effect on any current or future decisions by the Trustees.
 | Scholarships shall
be awarded in honor of any man or woman dying in the prior year from
wounds or injuries suffered while serving in Afghanistan or Iraq as a
member of the U.S. Army, U.S.Air Force, U.S. Coast Guard, U.S.
Marines, or U.S. Navy. |
 | At the time of
death, the deceased shall not have been under any indictment or
conviction for a major breech of the Uniform Code of Military Justice,
as may be amended from time to time. |

Death of the deceased shall have been from
physical wounds or injuries that actually were occurred while on duty
in Iraq or Afghanistan, regardless of whether caused by hostile
action, accident, or disease. |
The scholarship shall be awarded to the person or persons selected by
the Next of Kin designated in the deceased’s military records. MilVets
shall have no obligation to investigate or consider the validity of the
deceased’s designated Next of Kin. MilVets and its designated
representative shall incur no liability if a scholarship is
granted to a person selected by the Next of Kin,
who is later discovered not to be the legal Next of Kin of the deceased.
 | The deceased must have been a
resident of Central Ohio prior to joining the US military. Central
Ohio shall include all communities located in Delaware, Franklin,
Fairfield, Licking, Madison, Pickaway, and Union counties. |
 | The recipient of the educational
scholarship shall sign an affidavit affirming that they will use the
funds received only for post-secondary educational expenses and comply
with all conditions established by the IRS for the 529 College Savings
Plans. If it is subsequently reveal that the recipient has not used
the funds for post-secondary educational expenses, they shall be
obligated to return that portion of the funds not spent on
post-secondary educational expenses. MilVets, at its sole discretion,
shall determine what actions shall be taken to recover any such
improper use of funds. |
